Donate to Charity Specific Terms and Conditions

  1. If you are a Seller and you wish to donate the proceeds of sale of your specified goods or to a nominated charity you may select "Donate to Charity" as your payment method ("Donate to Charity" function).
  2. The Website General Terms and Conditions ("General Terms") apply to Donate to Charity listings and transactions and should be read in conjunction with these "Donate to Charity" Specific Terms and Conditions ("Charity Terms").
  3. If you are selling or buying Goods or Services through the Donate to Charity function you also agree to be bound by these Charity Terms. If you do not accept these Charity Terms, do not sell or buy any Goods or Services through the Donate to Charity function or otherwise transact with any Goods or Services offered through the Donate to Charity function.
  4. All Goods or Services offered through the Donate to Charity function shall be advertised, sold and bought in accordance with the General Terms. However, in addition:
    1. the Seller must only offer Goods for "pick up" and/or "free shipping";
    2. the Seller must nominate a charity from those set out on the Website ("Nominated Charity") and the proceeds of sale will go directly to that Nominated Charity;
    3. the Seller acknowledges that when Goods or Services are sold to a Buyer the Seller will not receive the purchase price and that it will be paid directly from the Buyer to the Nominated Charity through the Quick Pay facility on the Website.
    4. once the payment in clause 4(c) has been confirmed by email to the Seller the Seller will complete the transaction and deliver the Goods or provide the Services to the Buyer as agreed with the Buyer;
    5. the Seller acknowledges that if the Buyer alleges that the Seller has not completed its obligations under the General Terms or these Charity Terms to the satisfaction of the Buyer, we may provide the Buyer with the contact details of the Seller in order for the Buyer to progress the matter further; and
    6. the Buyer acknowledges that if the Seller or the Nominated Charity allege that the Buyer has not completed its obligations under the General Terms or these Charity Terms to the satisfaction of the Seller or the Nominated Charity, we may provide the Seller and/or the Nominated Charity with the contact details of the Buyer in order for the Seller and/or the Nominated Charity to progress the matter further.
  5. Any transaction entered into through the Donate to Charity function is entered into between the Seller and the Buyer and you acknowledge that Sella and/or the Nominated Charity are not parties to any such transaction. As such:
    1. the Seller and Buyer are responsible to each other in accordance with the General Terms, as if the Nominated Charity was not receiving the proceeds of sale;
    2. no responsibility for the condition of Goods or suitability of the Services is assumed by Sella or the Nominated Charity;
    3. the Seller and Buyer indemnify Sella (as per clause 13 of the General Terms) and the Nominated Charity from any claims, actions, costs (including legal costs) or losses due to or arising out or any transaction entered into through the Donate to Charity function; and
    4. once the Nominated Charity has received the proceeds of sale of Goods or Services sold through the Donate to Charity function it will not be required to refund that money. However, if Goods are not delivered or Services are not provided to the Buyer in accordance with the General Terms or these Charity Terms the Nominated Charity may, at its discretion, choose to offer a refund to the Buyer.
  6. Sella reserves the sole right to select charities to be involved in this process. We also reserve the right to remove charities at our sole discretion, provided that removal of a charity will not prevent a Nominated Charity from receiving the proceeds from the sale of any Goods or Services listed on the Website prior to the date of removal of that Nominated Charity.
